1. GENERAL PROVISIONS
1.1. The Terms and Conditions are applicable to all legal relations between the Customer and the owner of the Alintek.lv shopping environment (hereinafter – Alintek online store) SIA “Alintek”, reģ.nr. 40003226944 related to the purchase of goods in the Alintek online store.
1.2. Alintek has the right to unilaterally change or supplement the terms by publishing the new terms at the web address www. Alintek.lv. If the Customer has placed an order before the changes in the conditions have come into force, the rules in force at the time of placing the order shall apply, unless otherwise provided for in regulatory enactments or these Regulations.
1.3. The customer can, if necessary, save, print or reproduce the terms before making a purchase. By making a purchase in the online store, the Customer confirms that he has given his consent to these terms.
1.4. In addition to these terms, the laws and regulations in force in the Republic of Latvia are also applicable to making a purchase in the online store.
1.5. In relation to legal persons and persons who acquire or could acquire goods or use them for a purpose related to its economic or professional activity, Paragraph 6 of this Regulation – return of goods, withdrawal from the contract and refund of payment (right of withdrawal) – does not apply.
2. PLACING AN ORDER
2.1. The customer selects the desired goods in the online store and adds them to the shopping cart.
2.2. The customer chooses the type and place of delivery of the order.
2.3. The customer confirms the contents of the cart and pays for the goods in the payment environments offered by Alintek. Before paying for the waybill, the Customer checks whether the data specified in the waybill corresponds to the true wishes of the Customer.
2.4. After making the payment, the Customer presses the link “Return to the seller”.
2.5. Alintek sends a confirmation e-mail to the Customer’s e-mail about receiving the order and payment. If the confirmation email is not received, the Customer must contact customer service by e-mail info@Alintek.lv or phone no. +371 67250002 Monday to Friday, at 10:30 a.m. 8.30–16.30.
2.6. The consignment note is sent to the customer together with the goods.
2.7. The contract for the purchase of goods is considered concluded (the Agreement enters into force) at the moment when the payment amount corresponding to the order confirmation is received in the current account of SIA “Alintek”.
3. PRICE OF GOODS, PAYMENT OPTIONS, ADVANTAGES OF ALINTEK
3.1. The price of all goods sold in the online store is indicated in euro. The price of goods includes 21% value added tax.
3.2. Independent customer discounts in the Alintek online store are applicable to Customers who have registered as independent customers of the AlintekPro loyalty program. The general terms and conditions for Alintek independent customers are available on the www.Alintek.lv website.
3.3. The customer makes a prepayment of the price of the ordered goods and delivery costs in full. Payment is made outside the online store – in the payment environment. Alintek does not have access to the Customer’s bank and credit card details.
3.4. If the Customer does not choose to receive the ordered goods in the Alintek instrument trading center, the costs of delivery of the goods are added to the purchase price according to the delivery conditions.
3.5. In order to make a payment, the Customer selects the desired payment method on the website at the time of purchase:
3.5.1. Via internet banking;
3.5.2. By credit card (Visa or MasterCard) or PayPal payment system.
3.5.3. With a prepaid invoice. By choosing the payment method “Prepaid invoice”, the invoice will be sent to the Customer’s registered e-mail. The ordered goods will be reserved at the latest on the next business day after receiving the amount indicated in the prepaid invoice in Alintek’s current account.
3.5.4. The customer can apply for Alintek payment by filling in the payment application form in the description of the product.
3.6. A service fee may be added to the order price in accordance with the agreement concluded between the Customer and the Customer’s bank.
4. RECEIPT OF GOODS
4.1. Goods can be ordered for pick-up at Alintek instrument shopping centers, Omniva or DPD parcel machines or at the address specified by the Customer using courier services.
4.2. Orders placed in the online store are processed on weekdays from noon. 8.30 to 17.00. Orders placed on Saturdays, Sundays and public holidays are processed on the next business day. It is also applicable if “Receiving an order in the Alintek store” is selected.
4.3. Receipt of goods from Alintek.
4.3.1. The issuance of goods takes place during the working hours of the Alintek instrument trading center.
4.3.2. The goods shall be issued to the Customer upon presentation of an identity document (ID card or passport) and order number. In the absence of identity documents, Alintek does not issue the product to the Customer.
4.3.3. Alintek shall not be liable for losses incurred by the Customer due to reasons beyond Alintek’s control, such as third parties accessing a copy of the waybill or unique order number.
4.3.4. Delivery costs are not added to the purchase amount for goods selected for receipt at the Alintek instrument trading center.
4.3.5. If the Customer does not withdraw the product within 14 calendar days, Alintek considers that the Customer has abandoned the order and immediately, but not later than within 14 calendar days, transfers the purchase amount back to the Customer to the same current account from which the payment for the purchase was made.
4.4. Receipt of goods from the parcel machine.
4.4.1. When delivering the goods to the parcel machine selected by the Customer, delivery costs are added to the price of the goods.
4.4.2. The Customer is informed about the delivery of the goods to the specified parcel machine by SMS message to the phone number specified by the Customer during the purchase. The sent SMS message contains the unique door code for opening the parcel machine.
4.4.3. Alintek shall not be liable for the Customer’s losses if third parties have accessed the unique parcel machine code for reasons beyond Alintek’s control, and the Customer has lost the goods.
4.4.4. If the Customer has not removed the goods from the parcel machine by the end of the storage period, Alintek considers that the Customer has abandoned the order and immediately, but not later than within 14 calendar days, transfers the purchase amount back to the Customer to the same current account from which the payment for the purchase was made.
4.5. Receipt of goods by courier.
4.5.1. When delivering goods via courier services, delivery costs are added to the price of the goods.
4.5.2. The courier delivers the goods within five working days from the date of entry into force of the contract of sale. The courier delivers the goods on weekdays from noon. 10.00 to 21.00. Before making delivery by phone, the courier agrees with the Customer on the exact delivery time.
4.5.3. The customer ensures the receipt of the goods at the agreed time and address. If the delivery of the goods fails for reasons beyond the control of the courier twice in a row, the goods are delivered to the terminal of the courier company. In this case, the Customer can contact the courier within 14 days and ask for the goods to be re-delivered via courier to the address specified by the buyer. If the above-mentioned attempt to deliver the goods to the Customer fails, Alintek considers that the Customer has abandoned the order. In this case, the terms of this agreement on the receipt of goods from Alintek shall apply, and the Customer shall be refunded the purchase amount, including delivery costs, within 14 calendar days from the date of receipt of the goods back by Alintek, by making a transfer to the same current account that was used to make the purchase.
4.6. Inspection of goods.
4.6.1. Upon receipt of the goods, the Customer undertakes to carefully open the packaging without damaging either the packaging or the product. If the Customer has negligently damaged the packaging, i.e. it was possible to open the product packaging without damaging it, Alintek has the right to claim compensation for the damage caused by the damage, in case the Customer returns the goods to Alintek. If it is not possible to open the product packaging without damage/breaking it, the Customer is not responsible for damage to the packaging.
4.6.2. If, upon receipt of the goods, the Customer finds that defective or non-compliant goods have been delivered to him/her, or the goods do not reach the Customer in good condition or the packaging is open (or obviously damaged), the Customer shall immediately inform Alintek customer service about the incident by e-mail info@Alintek.lv or phone no. +371 67250002.
4.6.3. Alintek is responsible for the goods purchased by the Customer during their delivery. The risk of loss or damage to the goods passes to the Customer from the moment the Customer has received the goods.
5. PROCESSING OF CUSTOMER’S PERSONAL DATA
5.1. Alintek uses the personal data provided by the Customer and data on purchases in accordance with the Personal Data Processing Law, insofar as it is necessary to place the Customer’s order in the online store. Alintek does not transfer the Customer’s personal data to third parties, except for companies that provide postal or courier services, insofar as these data are necessary to deliver the goods to the Customer. By making a purchase in the Alintek online store, the Customer gives his consent to the processing of personal data.
5.2. Alintek does not have access to the Customer’s bank data when paying for goods via Internet Banking.
5.3. Alintek reserves the right to send information about products and partner offers to the customer’s email address and mobile phone number. The Customer has the right to request the deletion of his data from the Alintek database by sending a request to the e-mail address klients@Alintek.com.
6. RETURN OF GOODS, WITHDRAWAL FROM THE CONTRACT AND REFUND OF PAYMENT (right of withdrawal)
6.1. The customer has the right to withdraw from the contract within 14 calendar days from the moment of receipt of the goods (notice of delivery of the goods to the parcel machine, except if a defect of the goods is detected – see paragraph 7) without giving reasons. The time limit is complied with if the consumer sends the withdrawal form or a statement on the exercise of the right of withdrawal to the trader or the service provider before the expiry of the period of the right of withdrawal. The consumer is obliged to prove the exercise of the right of withdrawal. Within the meaning of these Terms, the Consumer is the Customer as a natural person who expresses a wish to purchase, purchases or could purchase or use a product for a purpose not related to its economic or professional activity.
6.2. In order to return the goods, the Customer must fill out an application for the return of the goods and send it to the Alintek instrument trading center together with the goods. When returning goods through a parcel machine, it is necessary to use the unique RETURN code. When returning goods via courier services, it is necessary to contact customer service by e-mail Info@Alintek.lv or tel. no. +371 67250002.

6.3. When exercising the right to return goods, the Customer is obliged to send the goods to Alintek no later than 14 days from the date of submission of the return application.
6.4. If the purchased goods are unsuitable for any reason, the Customer has the right to return them to the Alintek instrument shopping center, Omniva and DPD parcel machine or by courier within 14 days from the receipt of the goods. We recommend to Customers the goods they want to return, send or deliver immediately. The customer bears the expenses related to the return. If the expenses related to the return must first be paid by Alintek, then the direct costs related to the return of the goods will be deducted by Alintek from the amount of money returned to the Customer. Returned goods must be unused and packed in their original packaging. The customer is responsible for the decrease in the value of the product if the product has been used for a purpose other than to find out the nature, characteristics and operation of the product.
6.5. If the Customer has withdrawn from the transaction, Alintek shall immediately, but not later than within 14 calendar days from receipt of the return application, transfer to the Customer the amount of the purchase with delivery costs, if any. The refund is made to the same current account from which the payment for the purchase was made.
6.6. If the Customer has intentionally or negligently damaged the goods or the goods have been used for a purpose other than to find out the nature, properties and operation of the goods, and if the goods are returned using the right of withdrawal, Alintek has the right to claim compensation for the damage caused and the decrease in the value of the goods by making a deduction from the amount of money returned to the Customer.
7. SUBMISSION OF COMPLAINTS AND LIABILITY
7.1. SIA “Alintek” is responsible for claims and claims brought regarding non-conforming goods and their defects in accordance with the Consumer Rights Protection Law. A natural person who purchases or could purchase or use goods for a purpose not related to his economic or professional activity may lodge complaints within two years, all legal persons and natural persons who acquire or could acquire goods, or use them for purposes related to his economic or professional activity, within 6 months from the moment of receipt of the goods. In relations with legal entities and natural persons who acquire or could acquire goods or use them for a purpose related to its economic or professional activity, the Consumer Rights Protection Law does not apply.
7.2. The Customer submits a complaint by sending it to the e-mail address klients@Alintek.com or submitting it to the customer service of Alintek’s place of operation. The complaint must indicate the Customer’s name, surname and contact details, the date of submission of the complaint, the defect of the product and the content of the complaint to be submitted. The complaint must be accompanied by a document proving the making of the purchase.
7.3. SIA “Alintek” is not liable for losses of the Customer or late delivery of goods, if the loss or delay in the delivery of the goods occurred due to circumstances that SIA “Alintek” could not influence and the occurrence of which SIA “Alintek” did not foresee and could not foresee (force majeure).
7.4. Alintek is not liable for losses incurred from the use of the ordered goods for unforeseen purposes, as well as if a delay in delivery has occurred when the Customer indicates erroneous information.
7.5. The parties resolve disputes between the Customer and Alintek through negotiations. If no agreement is reached during the negotiations, the parties have the right to go to court. Any dispute, dispute or claim arising from these Terms and Conditions as an agreement between SIA “Alintek” and the Client, which concerns it or its violation, termination or (non-)validity will be resolved in the Vidzeme District Court in Cēsis as a court of first instance and in the Vidzeme Regional Court as a court of second instance.
8. MAINTENANCE AND REPAIR PERFORMED BY ALINTEK
8.1. Alintek repairs the damages and defects specified by the Customer’s goods during the repair works. Damages and defects are recorded in writing in the maintenance order confirmation.
8.2. Maintenance is understood to mean preventive measures taken to ensure the long-term service life of the device in accordance with the manufacturer’s instructions for use or maintenance log.
8.3. Maintenance does not imply the reconstruction or replacement of equipment.
8.4. Alintek may charge for the preparation of a repair estimate. The actual cost of the repair may differ from the estimate, but deviations in actual costs from the estimate will not be significant.
8.5. When handing over goods for maintenance or repair, a deadline is set for the detection of damages and defects, of which the Customer is informed.
8.6. Alintek uses its own purchased materials to carry out maintenance and repair work.
8.7. Alintek performs the elimination of other damages and defects discovered during maintenance or repair by agreement with the Customer.
8.8. Alintek undertakes to make an entry in the maintenance log for the work performed during maintenance, if the Customer has submitted the maintenance log to Alintek.
9. PURCHASE GUARANTEE
9.1. The purchase guarantee issuer shall provide the goods with a purchase guarantee in accordance with the following conditions. Within the meaning of these conditions, the Consumer is a natural person if the purchase of the goods is not related to their independent economic or professional activity.
9.2. If defects in material, construction or assembly become noticeable during the period of the purchase warranty, the issuer of the purchase guarantee organizes free repair of the goods.
9.3. If the repair of the goods is unsuccessful or, in the opinion of the issuer of the purchase guarantee, the issuer of the purchase guarantee shall change the goods free of charge.
9.4. If the repair of the goods is unsuccessful or economically inefficient in the opinion of the issuer of the purchase guarantee, but the change of goods is not possible (mainly if the goods are no longer produced), the issuer of the purchase guarantee returns to the Customer the money paid by it.
10. The purchase guarantee does not apply if:
10.1. It is not possible to identify the serial number of the product;
10.2. Damage to the product is caused by improper use;
10.3. Damage to the product is caused by wear and tear of the product;
10.4. damage to the product is caused by extreme exposure to the external environment (excessive moisture, heat, impact, etc.);
10.5. Damage to the product is caused by an accident (for example, a fall);
10.6. Damage to the product is caused by non-compliance with the instructions specified in the manual or other document provided with the product.
10.7. Regular maintenance is specified in the maintenance logbook, manual or other document issued with the product, but the Customer has not turned to the representation of the purchase guarantee issuer for timely maintenance.
11. Expiration of the warranty period of the purchase
11.1 . The warranty period of the purchase expired if:
11.1.1. At the end of the warranty period;
11.1.2. In case of damage or removal of the serial number of the goods;
11.1.3. If the Customer or a third party who is not the issuer of the purchase warranty, performs repairs or attempted repairs.
11.2. If a defect in the material, construction or assembly becomes noticeable during the period of the purchase guarantee, the Customer has the right to contact the representatives of any of the purchasers during the period of the purchase guarantee. Representations of the purchase guarantee can be found on the website www. Alintek.lv.
11.3. By contacting the representative of the purchase guarantee issuer, the Customer delivers the goods to be repaired and describes the detected damages. Upon request for representation of the guarantee of purchase, the Customer submits documents proving the time of purchase of the goods (waybill or other document).
11.4. The purchase guarantee issuer repairs the goods free of charge within a reasonable period of time, which does not exceed 30 days. The Purchase Guarantee Issuer shall inform the Customer about the repair of the goods by phone or e-mail. After repair, the Customer receives the goods at the same representative office where they were delivered for repair.
11.5. If the repair of the goods is unsuccessful or, in the opinion of the issuer of the purchase guarantee, the issuer of the purchase guarantee shall inform the Customer thereof by phone or e-mail, at the same time informing about the date on which the Customer can receive the changed goods as soon as possible. The customer will receive the changed goods from the same representative office where the original goods were handed over for repair.
11.6. If the repair of the goods is unsuccessful or economically unprofitable in the opinion of the purchase guarantee issuer, but the exchange of the goods is impossible and the purchase guarantee issuer has made a decision to return the money for the goods, the purchase guarantee issuer shall inform the Customer thereof by phone or e-mail. In this case, the Customer is obliged to notify his current account number, to which the issuer of the purchase guarantee can transfer money for the product. The Purchase Guarantee Issuer shall return the money within 14 days from the date of receipt of the Customer’s current account number. Return of money to the current account of a third party is possible only after submitting a written application of the Client.
11.7. The Purchase Guarantee Issuer shall not compensate the Customer for transportation costs or losses incurred during repairs when it was not possible to use them. In no case shall the Purchase Guarantee Issuer compensate the Customer for the loss of profit.
11.8. The warranty period for the purchase is extended by the time during which the goods were repaired. The specified period of time begins on the day when the Customer delivers the goods to be repaired to the warranty issuer and ends on the day when the purchase warranty issuer informs the Customer about the completion of the repair.
11.9. If the purchase guarantee issuer changes the goods free of charge, the term of the purchase guarantee does not change. It remains as it was for the purchased item. But in this case, the warranty period is extended by the time during which the product was under repair until its exchange. The warranty period is extended by the time when the Customer delivers the goods to be repaired and expires on the day when the purchase guarantee issuer informs the Customer about the receipt of the replaced goods.
11.10. If the Consumer Rights Protection Law is applicable to the purchase, in addition to the above-mentioned provisions, the provisions of the Consumer Rights Protection Law shall also apply to the purchase guarantee.
